You can legally create a California living trust yourself. A trust only protects what’s moved into it, though, and that’s where most DIY plans break.

"(《世界人权宣言》) 遗产规划 团队在 Quinn & Dworakowski 律师事务所 drafts trusts for Orange County families in English and Chinese. We review DIY trusts too.

Is a DIY Living Trust Legal in California?

Yes, a DIY living trust is legal in California. California Probate Code Section 15200 lets you create a trust by declaring that you hold property as its trustee, with no attorney required. The trust itself doesn’t need a notary, but the deed moving your home into it does.

Where Can DIY Living Trusts Go Wrong?

DIY trusts usually fail after the signing.

  • No trust transfer deed is recorded with the 奥兰治县书记官兼登记官, so the house stays in your name.
  • Married couples skip the community property schedule, leaving a spouse and children to argue over who owned what.
  • There’s no pour-over will. This backup will sends forgotten assets to your trust. But assets that pass through it may still need probate if they’re worth enough.

Quinn & Dworakowski offers consultations to catch these gaps early.

What an Unfunded Trust Costs Orange County Families

An unfunded California living trust can send your family to probate court. Some families can use a simpler court process or a short form instead, depending on what was left outside the trust. But when a full probate is needed, statutory fees can reach $46,000 on a $1 million estate.

A 2025 shortcut under Probate Code Section 13151 covers primary residences up to $750,000, but few homes in Irvine or Newport Beach sell that low. Those cases go to the 科斯塔梅萨司法中心 and often run past a year.

When Should You Hire an Attorney for Your Trust?

Hire a California living trust attorney once your plan involves an Orange County home, children from a prior marriage, or a child with special needs. Those need terms a template can’t write, and passing down a house raises 第 19 号提案 reassessment questions. A California living trust attorney also helps you choose a capable successor trustee.

常见问题

签署生前信托后,我可以对其进行修改吗?

Usually, yes. In California, a trust can be cancelled by the person who made it unless the trust document clearly says it can’t be. You can also change it using the same steps allowed for cancelling it, unless your trust document sets different rules. That means a DIY trust can be updated as your family or property changes.

Will putting my house in my trust raise my property taxes?

Usually not. Moving property into your own 可撤销信托, when you are still the beneficiary, is not treated as a change in ownership, so it doesn’t trigger a new assessment. Reassessment questions come up later, when the trust passes the home to someone else after your death.

What if I forgot to put an asset in my trust?

Your successor trustee may fix it with a Heggstad petition asking the court to treat the asset as trust property. It’s still an Orange County Superior Court filing, so keep your signed asset schedule current.
