Loving someone does not give you the right to act for them. A parent with dementia may miss bills or fall for scam calls. The bank still will not let you step in, and neither will the care home. The same wall goes up the day an adult child with autism turns 18.
Both founding partners of Quinn & Dworakowski, S.L. are certified by the State Bar of California as Family Law Specialists. The firm’s conservatorship lawyers serve Mission Viejo families from its office in Irvine.
We first check whether a power of attorney or trust already solves the problem. If not, we build a petition that shows the judge what your loved one can and cannot do. Then the right person holds authority before the next bill or hospital form arrives. Tell us who you are worried about and what stopped working. A trusted Mission Viejo estate planning lawyer can help you understand your options and whether court involvement is necessary.

The probate court sorts most adult conservatorships into two tracks. A general conservatorship covers an adult with dementia, Alzheimer’s, or a brain injury. A limited conservatorship covers an adult with a developmental disability, such as autism or Down syndrome. We handle both, along with the work that comes after:
If you are not sure which track fits, that is the first question we answer with you.
Worry alone will not get a conservatorship granted. The court needs proof that your loved one cannot meet basic needs for health, food, clothing, or shelter. For control over money, it needs proof they are substantially unable to manage their finances or resist fraud or undue influence (Código Sucesorio de California, artículo 1801). That proof must be clear and convincing, a higher bar than most civil cases require.
So what does waiting cost? In Mission Viejo, 22.7% of residents are 65 or older, according to the U.S. Census Bureau. For many families, the moment comes after a fall and a hospital stay. A discharge planner asks for a signature, and no one in the family can legally give it. We gather doctor statements, bank records, and a plain timeline of what changed. That way the judge has what it needs at the first hearing. This reflects California law as of September 2026.
Conservatorship cases for Mission Viejo families are heard at the Complejo Judicial de Costa Mesa, 3390 Harbor Blvd. in Costa Mesa. It is a full security building, so leave pocketknives and scissors at home. Before your hearing, the court offers a free online conservatorship orientation in 7 languages, including Korean and Mandarin. Attorney Shanshan “Sophy” Han, who leads the firm’s Estate Planning & Probate Department, is fluent in both.
We prepare the filings and appear with you in Costa Mesa. Our office is at 2050 Main Street in Irvine, and much of the preparation can happen by phone or video. If a parent’s estate later goes through probate, our Mission Viejo probate lawyer works from the same file.
Bring your loved one’s doctor names, any recent medical notes, and any trust, will, or power of attorney they signed. A rough list of accounts and monthly bills tells us fast whether the money side of the case is needed.
Sometimes, yes. A judge must find that conservatorship is the least restrictive option, after weighing powers of attorney, health care directives, and supported decision-making agreements (Código Sucesorio de California, § 1800.3). If your parent signed a durable power of attorney while still able, it may already cover what you need.
At 18, you lose the legal right to see your child’s medical records or sign papers for them. Starting a limited conservatorship before the birthday avoids that gap, and a regional center report, done with your child’s consent, is part of the case.
When the need cannot wait for a regular hearing, we can ask the court to appoint a temporary conservator. The request is filed with the main petition and is usually heard about one week later, once your parent has been personally served at least 5 court days ahead.
Yes. Staff from Probate Court Services speak with both the conservatee and the conservator on a regular schedule. Conservators who manage money also file accountings, which Orange County accepts through an online Conservatorship Accounting Portal.
A close friend can serve, and so can a licensed private professional fiduciary. If no suitable person steps forward, the court may appoint the Public Guardian.
If your family’s question is not on this list, bring it to a consultation and we will answer it in plain terms. For county-wide details, see our Orange County conservatorship page.
You do not have to sort out doctors, bank forms, and worried relatives on your own. Families often hire us specifically for trial, so we build every petition to hold up if a relative contests it.
