Conservatorship Work We Handle for Orange Families, From Dementia Powers to Successor Conservators

Most families in Orange reach us with one urgent problem and 2 or 3 quieter ones behind it. We handle each of these:

  • Dementia conservatorships: a conservatorship of the person with added court powers to approve a secured memory care placement or dementia medications.
  • 재산 관리권: authority to manage a pension, Social Security, a house in Old Towne, or an investment account, and to report every dollar to the court.
  • 임시 후견: short-term authority when a hospital discharge date or a draining bank account cannot wait for the full hearing.
  • 제한적 후견: tailored powers for an adult child with a developmental disability, usually filed close to their 18th birthday.
  • Contested petitions: cases where a sibling, a new partner, or your loved one objects to the petition or to who should serve.
  • Successor conservators: stepping in when the current conservator passes away, burns out, or can no longer serve.

Many cases involve two of these at once, such as a dementia petition that also requires control of the money. A 신뢰할 수 있는 오렌지 지역 유산 계획 전문 변호사 can help identify these needs during the first meeting, ensuring the petition addresses everything your loved one needs from the start.

Why a Locked Memory Care Move Needs a Separate Order From the Judge

A standard conservatorship lets a conservator decide where your loved one lives. On its own, it does not let the conservator place them in a locked memory care unit or approve medications used to treat dementia. For those 2 steps, the judge must make extra findings on clear and convincing evidence, meaning strong and specific proof (Cal. Probate Code § 2356.5).

The judge must find that your loved one has a major neurocognitive disorder, the medical term for dementia. The judge must also find that they cannot consent and that they need it or would benefit from it. For a locked placement, the judge must also find that it is the least restrictive setting that meets their needs. A doctor or psychologist must back up each finding in a signed statement. What happens if a family skips this step? A secured facility may turn down the admission, or someone could challenge the placement later.

When the medical records support it, we ask for these powers in the first petition, so your family is less likely to need a second court request. The court still reviews these powers every year. This reflects California law as of September 2026.

Who Serves as Conservator When Brothers and Sisters in Orange Disagree

When siblings disagree, a conservatorship case can slow down. California gives the judge an order of preference to use when two or more people are equally qualified (Cal. Probate Code § 1812). Your loved one’s own stated preference comes first, even when they share it through gestures, facial expressions, or other ways besides speech. After that comes a spouse or domestic partner, then an adult child, then a parent, then a brother or sister. The judge can still pass over anyone on that list if the choice would not serve your loved one’s best interest.

That best-interest question decides most contested cases. Our co-founder 데이비드 드워라코프스키 ran the Writs and Appeals Department at the Orange County Public Defender’s Office, an office of more than 200 lawyers. We prepare a contested petition the way trial lawyers do, with witnesses and records ready, so the judge can see who has kept your loved one safe and cared for.

Questions Orange Families Ask Us Before the Hospital Discharge Date

What happens first after we contact you?

We review your loved one’s diagnosis, living situation, and finances, and tell you whether you need a conservatorship at all. If a signed power of attorney or health care directive already covers the problem, we will tell you that too.

Is a conservatorship for an Orange resident heard at the Lamoreaux Justice Center?

No. The 라모로 사법 센터 on The City Drive South in 오렌지 handles family law, juvenile, and domestic violence cases. 유언 검인 hearings, including conservatorships, moved to the 코스타 메사 사법 단지 at 3390 Harbor Blvd. for all hearings on or after May 1, 2023. Some older guides still list the Orange courthouse, so check any form you find online.

Who keeps track of the money once a conservator is appointed?

A conservator of the estate files an inventory and regular accountings that show every dollar in and out. Sophy Han, who leads our probate department, is an IRS Enrolled Agent with over 5 years of investment banking experience, and she also meets with families in Mandarin and Korean.

How much does a conservatorship cost?

Cost depends on whether anyone objects and how much property is involved. Court filing fees are separate from attorney fees, and we give you an estimate for your family’s case at the consultation.

Does my loved one lose all their rights?

No. But some rights change automatically. If the court names a conservator of their estate, they generally can no longer sign contracts or make deals that bind their money. Beyond that, they keep the rights the judge does not take away. They can also ask the court to change or end the conservatorship later.

Bring the discharge paperwork or the latest note from her doctor to your consultation, and we will start from there.
