If a loved one can no longer manage their health or finances due to illness or injury, family members quickly run into legal roadblocks. Banks and doctors cannot take your word for it. They require official legal authority before letting you step in.
Before taking legal action, it helps to understand whether a full conservatorship is necessary or if a simpler alternative will work. If you need an experienced Garden Grove conservatorship attorney, the team at Quinn & Dworakowski, LLP can help.
Tell us about your situation, and we will lay out your options to protect your loved one.

Conservatorships often start with 2 plain questions: what does this person need help with, and how much help?
A conservatorship takes rights away from an adult, so California sets a high bar. The judge must find clear and convincing evidence, which means strong and specific proof, that your loved one cannot properly meet basic needs for health, food, clothing or shelter, or is substantially unable to manage money or resist fraud or pressure from others (Cal. Probate Code § 1801). On their own, a few isolated missed payments or one bad money decision are not enough to prove this.
The judge must also find that a conservatorship is the least restrictive option. That means the judge looks first at other tools, such as a power of attorney, an advance health care directive, or a supported decision-making agreement, where trusted people help your loved one make their own choices (Cal. Probate Code § 1800.3).
A court investigator will interview your loved one, who has the right to object, request a jury trial, and have a lawyer. A dedicated Garden Grove estate planning lawyer can help them understand their rights and legal options. If they do not hire a lawyer, the court will appoint one for them.
Garden Grove sits in west Orange County, but its conservatorship cases are not heard at the nearby West Justice Center in Westminster. The court’s probate and mental health clerk’s office and courtrooms are at the Costa Mesa Justice Complex, 3390 Harbor Blvd., Costa Mesa.
New conservators must complete a court orientation, and the court offers it online in 7 languages, including Vietnamese, Korean and Mandarin.
If your family would rather talk the case through in Mandarin or Korean, Sophy Han, who leads our estate planning, trusts and probate department, speaks both.
You can file on your own, but the petition must list the other options you considered, such as a power of attorney or a supported decision-making agreement, and explain why they will not meet your loved one’s needs, and gaps in the paperwork can push back your hearing. A lawyer matters most when a relative objects or large assets are involved.
If your loved one can say who they want, that choice comes first. The judge will usually appoint that person unless it is not in your loved one’s best interest. After that, the law favors a spouse or domestic partner, then an adult child, then a parent, then a sibling.
It can. A conservatorship lasts until your loved one passes away or a judge ends it. Your loved one or family can ask the court to end it if it is no longer needed. A court investigator also checks in on the case regularly after the appointment.
The hearing can get pushed back while your family keeps waiting. We gather doctor statements and financial records up front, so the judge sees the full picture the first time. After appointment, you report to the court, and a conservator can be held personally responsible for mismanaging the conservatee’s money.
If your question is not listed here, bring it to a consultation and we will answer it with your family’s details in front of us.
