Probate is rarely one task. Most estates need two or three of the following, and we handle each of them inside the same office.
Probate deadlines start before most families have planned the service. Whoever holds the original will has 30 days after learning of the death to deliver it to the superior court and mail a copy to the named executor, unless someone has already filed to open probate. A person who holds on to it can be personally liable for the harm the delay causes (California Probate Code § 8200).
The house is usually the next hurdle. When a person dies on or after April 1, 2025, and leaves more than $208,850 in property that does not pass through a trust, joint title, a named beneficiary, or to a surviving spouse, the family generally cannot use the simple affidavit process (California Probate Code § 13100). A single-family home in Orange commonly sells for more than that, so many estates without a trust need some kind of court case. For a primary home worth $750,000 or less, that may be a shorter petition instead of full probate. Taxes come next, including a final income tax return and property tax questions if the children plan to keep the home. What happens if a creditor or a sibling files first? The timeline stretches and the costs rise, and an early plan keeps those decisions with the family.
This information reflects California law as of September 2026.
Many families in Orange expect to file at the Lamoreaux Justice Center on The City Drive, since it is the Superior Court building in the city. Lamoreaux handles family law, juvenile, and domestic violence cases, and the court moved all probate and mental health matters out of that building in July 2013. Probate for anyone who lived in Orange is now filed and heard at the Costa Mesa Justice Complex, 3390 Harbor Blvd. in Costa Mesa. The court also runs a probate mediation program for families who disagree about an estate. We prepare the filings, track the hearing dates, and tell you ahead of time whether anyone in the family needs to be there.
Bring the will or trust if one exists, a death certificate, and recent statements for the home, bank accounts, and retirement accounts. We use those to see how each asset is titled, which tells us whether you need full probate, a shorter petition, or no court case at all.
Sometimes. If the property that would go through probate is worth $208,850 or less, heirs can often collect bank accounts and other personal property with a sworn affidavit once 40 days have passed since the death. The affidavit does not transfer a house. For deaths on or after April 1, 2025, a shorter court petition may cover a primary home worth up to $750,000. That limit is based on the home’s full value, before subtracting any mortgage.
That happens often, and it usually does not mean full probate. If the trust documents show the person meant the home to be included, we can file a Heggstad petition asking the court to confirm the home belongs to the trust.
The court appoints an administrator instead. A surviving spouse or registered domestic partner generally has first priority, followed by the children, and we help the family agree on who should step forward before anything is filed.
The court’s probate mediation program can help settle disputes over a will, an executor, or the sale of a home. If mediation fails, a probate judge decides, and our trial attorneys prepare the case for that possibility from the start.
